These Terms apply to ExecutiveCatHerder.com and other websites, landing pages, digital properties, resources, and online services operated by the Company (collectively, the “Site”).

By accessing or using the Site, you agree to these Terms. If you do not agree, you should not use the Site.

The Site provides information regarding the Company and its consulting, strategy, advisory, coaching, educational, speaking, event, artificial intelligence, business development, and related services.

Information available through the Site is provided for general informational and educational purposes unless you have entered into a separate written agreement with the Company for specific services.

Nothing on the Site creates a consultant-client, advisor-client, fiduciary, partnership, joint venture, employment, agency, or other professional relationship merely because you access content, submit a form, communicate with us, or purchase a generally available digital product.

2. NOT PROFESSIONAL LEGAL, TAX, FINANCIAL, MEDICAL, OR INVESTMENT ADVICE

Except as expressly authorized in writing, you may not copy, reproduce, republish, upload, distribute, transmit, sell, sublicense, modify, create derivative works from, commercially exploit, or otherwise use Company materials for commercial purposes.

Purchasing or receiving access to a product, program, event, consulting engagement, resource, or downloadable material does not transfer ownership of the underlying intellectual property.

5. PERSONAL AND INTERNAL BUSINESS USE

Unless otherwise stated in a separate written agreement, resources made available to you are licensed for your personal use or internal use within your business.

You may not:

  • Resell our materials

  • Repackage our materials as your own

  • Publish our proprietary frameworks

  • Use our materials to create a substantially similar competing product or service

  • Copy our training materials for use with your own clients

  • Distribute paid resources to individuals who have not purchased or been granted access

  • Represent Company materials, frameworks, methodologies, or concepts as your own work

Any broader licensing or commercial use requires prior written permission from the Company.

6. TRADEMARKS AND BRAND NAMES

Names, logos, slogans, program names, product names, and other brand identifiers associated with the Company may constitute trademarks or other protected intellectual property.

This may include, where applicable:

and other names, programs, frameworks, methodologies, or marks used by the Company.

Nothing on the Site grants you a license to use these marks without prior written authorization.

7. ARTIFICIAL INTELLIGENCE AND TECHNOLOGY

Some Company products, services, communications, analyses, or resources may incorporate artificial intelligence, automation, machine learning, or third-party technology.

AI-generated or AI-assisted output may contain errors, omissions, outdated information, or unexpected results.

You are responsible for reviewing and validating information before relying upon or implementing it.

Unless specifically agreed otherwise in writing, the Company does not guarantee the accuracy, completeness, reliability, availability, or suitability of AI-generated or automated output.

You should not use Company-provided AI tools or recommendations as the sole basis for high-impact legal, financial, medical, employment, safety, or other regulated decisions.

8. USER CONDUCT

You agree not to use the Site or our Services to:

  • Violate applicable laws

  • Infringe intellectual property rights

  • Attempt unauthorized access to systems or accounts

  • Introduce malware or harmful code

  • Scrape, crawl, harvest, or systematically extract Site content without authorization

  • Circumvent security or access restrictions

  • Impersonate another person or organization

  • Submit false or misleading information

  • Harass or threaten others

  • Interfere with Site operation

  • Use automated systems to improperly access or reproduce proprietary materials

  • Use our content to train, fine-tune, populate, or develop a competing commercial AI system, knowledge base, course, methodology, or product without written permission

We may restrict or terminate access for conduct that violates these Terms.

9. PURCHASES AND PAYMENTS

Certain products, programs, events, consulting services, or other offerings may require payment.

Pricing, payment schedules, deposits, cancellation provisions, refund policies, and other purchase terms may be provided at checkout, on an order form, proposal, statement of work, service agreement, event agreement, or other applicable document.

By purchasing an offering, you agree to the terms presented in connection with that purchase.

Unless otherwise stated in writing, amounts paid are in U.S. dollars.

You agree to provide accurate billing information and authorize the applicable payment processor to charge the payment method you provide.

10. REFUNDS AND CANCELLATIONS

Refund and cancellation rights vary by product, service, program, or event and will be governed by the specific terms disclosed at the time of purchase or in the applicable agreement.

Unless otherwise expressly stated in writing, purchases are considered final to the fullest extent permitted by applicable law.

Nothing in these Terms eliminates any refund, cancellation, or consumer right that cannot legally be waived.

11. EVENTS AND PROGRAMS

Participation in Company events, retreats, workshops, masterminds, programs, or similar experiences may be subject to additional registration terms, participation agreements, waivers, codes of conduct, cancellation policies, or other requirements.

Where additional terms apply, those terms are incorporated by reference and will control with respect to the applicable event or program if they conflict with these general Terms.

The Company reserves the right to modify event programming, speakers, schedules, venues, activities, or other details when reasonably necessary.

12. TESTIMONIALS AND CASE STUDIES

Testimonials, reviews, endorsements, client stories, and case studies represent individual experiences.

They are not guarantees of future performance.

Where we discuss specific client or business outcomes, those outcomes may reflect circumstances unique to that person or organization.

13. USER SUBMISSIONS

If you voluntarily provide testimonials, reviews, feedback, suggestions, comments, or other content intended for publication or promotional use, you represent that you have the right to provide that content.

When you expressly authorize us to use such material publicly, you grant the Company a non-exclusive, worldwide, royalty-free license to reproduce, display, distribute, and use the authorized material for legitimate business and promotional purposes, subject to applicable law and any written limitations agreed upon between you and the Company.

Confidential client information will remain subject to any applicable confidentiality agreement.

14. THIRD-PARTY LINKS AND SERVICES

The Site may contain links to third-party websites, applications, platforms, products, or services.

We do not control and are not responsible for third-party content, security, availability, privacy practices, products, services, representations, or business practices.

A link or reference does not necessarily constitute our endorsement.

Your interactions with third parties are governed by their respective terms and policies.

15. WEBSITE AVAILABILITY

We attempt to maintain accurate and available digital properties but do not guarantee that the Site will operate continuously or without errors.

We may modify, suspend, discontinue, or restrict any portion of the Site at any time.

17. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY AND ITS OWNERS, MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, REPRESENTATIVES, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR RELIANCE ON ITS CONTENT.

THIS INCLUDES, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOST BUSINESS OPPORTUNITIES, LOST DATA, BUSINESS INTERRUPTION, OR REPUTATIONAL DAMAGE.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY'S AGGREGATE LIABILITY ARISING OUT OF YOUR USE OF THE PUBLICLY AVAILABLE SITE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID DIRECTLY TO THE COMPANY SPECIFICALLY FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM DURING THE SIX MONTHS PRECEDING THE CLAIM OR $100.

This limitation does not apply where liability cannot legally be limited or excluded.

18. INDEMNIFICATION

We reserve the right to suspend or terminate access to the Site or restricted Company resources when we reasonably believe a user has violated these Terms, infringed our intellectual property, engaged in unlawful activity, or created a security risk.

Provisions concerning intellectual property, disclaimers, limitations of liability, indemnification, and other provisions that by their nature should survive termination will remain in effect.

21. GOVERNING LAW

The updated version will be posted on the Site with a revised “Last Updated” date.

Your continued use of the Site after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.

25. ENTIRE AGREEMENT

These Terms and our Privacy Policy constitute the agreement governing general use of the Site.

If you purchase services, participate in an event or program, or enter into another agreement with the Company, additional terms may apply.

If a separately executed written agreement conflicts with these Terms regarding the services covered by that agreement, the separately executed agreement will control.
